Debunking the Common Myths about Unpaid Overtime and Electricians

No one likes to think about what would happen if they were to lose their job, especially in this tough economy. Showing up to the job site, putting your time in, working hard, and keeping your employer happy is usually the main goal.

But what happens when you are being treated unfairly at work and are not receiving the overtime pay that you are entitled to as a Houston electrician? Do you say anything to your employer? What would happen?

There are certain myths surrounding the reason why some electricians refuse to speak up against unfair treatment under the Fair Labor Standards Act. But the Houston overtime attorneys at Kennedy Hodges want to help debunk these myths in hopes that we can help workers come forward and stake a claim to the compensation they are entitled to.

Myth #1. I already make a lot of money, which is why my employer does not pay me overtime. Truth: It doesn't matter if you make minimum wage or $100 per hour - as long as you are not exempt under the Fair Labor Standards Act (which most electricians are not), you are entitled to time and a half of your regular rate of pay for the hours you've worked over 40 in one week.

Myth #2. If I demand my unpaid overtime, my employer will fire me. Truth: Not only is it against the law for your employer to withhold overtime pay that you have earned, it is against the law for your employer to fire you for asking for your unpaid wages. If you are afraid to say something yourself, have an experienced lawyer tell them on your behalf.

Myth #3. I am not a U.S. citizen, therefore I am not entitled to overtime. Truth: As long as you have the right to work in the United States and you are non-exempt, you are covered under the Fair Labor Standards Act - regardless of where you work or how much you are paid.

Don't let these myths prevent you from obtaining the compensation that you have earned and deserve.
