Strip club owner's illegal pay practices revealed


Dancer hires wage attorney to recover overtime pay from strip club owner.

Strip clubs frequently subject dancers, bouncers, bartenders and servers to irregular pay practices and labor law violations. A 63-year-old strip club owner in Illinois is facing a wage and hour lawsuit by a former dancer who claims she was misclassified as an "independent contractor."

The dancer claims she worked over 40 hours weekly and some weeks she was not paid minimum wage. She is filing the overtime and wage claim for:

  • unpaid wages for the last five years, and
  • that other current or former strip club dancers or employees can join the wage claim.

The dancer from one of the three Illinois strip clubs claims she was misclassified as an independent contractor.

Other courts across the country have held that exotic dancers at "gentlemen's clubs" are not automatically considered independent contractors. Because the nude dancers are actually "employees," the clubs must pay them minimum wage and overtime pay. So, for example, a dancer who works 40 hours per week and is paid tips with no compensation from the club would be entitled to $290 for every week she worked. Over a year this comes to $15,080.

Double Damages. Under the Fair Labor Standards Act, a dancer would also be able to recover liquidated damages or double damages if a violation is proven. So, in that example above, the dancer's claim per year would be over $30,000.
