When you travel from state to state, you must abide by the different laws applicable in each jurisdiction. The California Supreme Court reached a new decision that applies that same logic to labor law protections for out-of-state workers.

California Supreme Court rules in overtime case

Out-of-state residents who work for California companies are eligible for state overtime and wage law protections, the California Supreme Court decided.

The class-action lawsuit involved instructors working for Oracle Corporation, a California company specializing in business software. Many of the out-of-state employees worked and lived outside of California and claimed that they were eligible for overtime pay on their business trips for the company into the state. The California Supreme Court agreed.

Who is affected?

Out-of-state residents who work for California companies have protections under a state labor law that requires overtime pay for business trips that require over eight hours in a single day.

The California court's ruling was aimed at overtime laws and it may help keep California companies in check by not bringing in workers from other states just to avoid overtime laws.
