California wage and hour case makes history. $17 million sought in record Minimum Wage case

A Fair Labor Standards Act lawsuit in California is now the largest in the state's history. ZipRealty Inc. is named in the lawsuit for allegations it frequently did not pay employees minimum wage. 
Misapplication of "Outside Salesperson" exemption leads to $17 million claim
The employees who filed against the San Francisco real estate brokerage firm were sales agents for ZipRealty. The company tried to argue that the employees were "outside salespersons" and therefore exempt from minimum wage and overtime, but the judge denied this saying the workers spent less than half of their time working outside the office.
