The owner of Ashley Furniture Home Stores in Lubbock, Texas, has agreed to pay over $57,000 in back wages to 170 current and former employees of the company's Texas stores in Lubbock, Amarillo and Midland and a store in Hobbs, NM, following a federal wage and hour investigation.
Back wages to the employees totaled $57,286. The company also agreed to pay $37,400 in penalties. The investigation revealed a variety of violations of the Federal Fair Labor Standards Act, including:
Commission workers did not always receive federal minimum wage,
Employees were not compensated for mandatory meetings,
Deductions were taken illegally for business cards, name tags, binders, postage stamps and other materials,
Paying hourly straight time wages instead of time-and-a-half for overtime hours,
Improperly classifying some employees as exempt from overtime and other FLSA provisions.
In addition, the company did not maintain all employee records required under the FLSA.
