Anti-Retaliation Lawsuit and $1 Million Fine for Houston A/C Company
A lawsuit has been filed against an air conditioning and heating company that reportedly violated anti-retaliation provisions after it terminated an employee who complained about the company's safety reporting practices. The former employee claims that he complained to supervisors about the company's failure to record job injuries and accidents and shortly afterwards was fired for insubordination.
The Houston-based Goodman Manufacturing Co. LP, and its parent company Goodman Global Inc., are named in the suit. The employee filed a compliant with OSHA about the company's practices after being fired, and OSHA performed a safety inspection at Goodman Manufacturing. OSHA issued 83 willful citations and fined the company $1.2 million for failure to report job-related injuries.
The Department of Labor filed suit against the company, seeking back pay, reinstatement, compensatory and punitive damages for the employee, and seeks to prevent Goodman Manufacturing from future retaliation against employees.
