Many companies will try any tactic to avoid paying their employees overtime. Internet and print companies are no different and will try to avoid the FLSA laws if they can get away with it. Many employees in the print and online advertising business are eligible for overtime pay.

Case in Point

Advertising sales employees file wage lawsuit against Yellow Pages publisher for allegedly denying employees millions in lost wages nationwide.

One of the largest Yellow Pages publishers in the U.S. has allegedly violated the federal Fair Labor Standards Act by failing to pay its advertising sales employees their proper overtime rate. The wage lawsuit is against SuperMedia, formerly known as IdeaArc Inc., which sells online and print advertising to businesses.

The wage and hour lawsuit claims that the company did not include the workers' commissions in their base pay when calculating overtime. Federal FLSA law requires that an employee's commissions be included in addition to their base salary when calculating overtime pay for hours worked over 40 in a workweek.

The lawsuit, filed in Dallas, seeks class-action status for hundreds of past and present employees' that are estimated to have been affected by Super Media's pay methods for the past three years.
